In the aftermath of President Donald Trump’s decision to bomb three of Iran’s nuclear facilities, numerous Democrats claimed the president’s actions were unconstitutional and a violation of the War Powers Resolution.
It is a contentious and hotly debated issue not only in Congress but also in academia.
He used military force unilaterally without even advising Congress. That violates the Constitution, as written. However, Congress has, especially in the past couple of decades transferred its authority to the executive in matters in which war wasn't declared. Keep in mind, the build up in Viet Nam was never 'declared' a war. In fact, we haven't been 'at war' since WW II!!! Its a bit hysterical and even hypocritical to call his action unconstitutional.
What should happen going forward is Congress should claw back its CONSTITUTIONAL authority to have the US engage in foreign military actions. There was no imminent threat of attack. There were no WMDs. There wasn't even credible threat of attack on a ally.
Is the is not the result of the war powers act? You know that one we passed that gave the president broad authority to authorize the use of military force unilaterally?
